These Terms of Service ("Terms") govern your use of the website rhda.us, the publisher catalog at catalog.rhda.us, and related online services (together, the "Services") operated by Redhead Digital Agency LLC ("Redhead", "we", "us", or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Our Services

Redhead provides business-to-business digital marketing services, including link building, SEO, and content writing. This website is informational. Marketing services are provided exclusively under individual service agreements, statements of work, or order confirmations concluded separately with each client ("Service Agreements"). If there is any conflict between these Terms and a Service Agreement, the Service Agreement prevails for the services it covers.

2. Eligibility

The Services are intended for businesses and professionals. By using the Services, you represent that you are at least 18 years old and, where acting on behalf of a company, that you are authorized to bind that company.

3. Publisher Catalog Access

Our catalog at catalog.rhda.us allows registered users to check whether specific domains are present in our publisher database. Access requires signing in with a Google account. By using the catalog, you agree that:

• Access is provided free of charge for evaluation purposes and does not create any service obligation on our part;
• You will not use automated tools (bots, scrapers, crawlers) to query the catalog, attempt to extract or reconstruct the database in whole or in part, or circumvent rate limits and access controls;
• You will not share your account access with third parties or use the catalog to build a competing product or dataset;
• Catalog information is provided "as is" for reference: the presence of a domain in the catalog does not guarantee placement availability, pricing, or turnaround, all of which are confirmed individually;
• We may modify, suspend, or discontinue the catalog, or suspend or terminate individual accounts, at any time — including for violations of these Terms.

4. Fees and Payment

Use of this website and the catalog is free. Fees for marketing services are agreed individually in the applicable Service Agreement and invoiced accordingly. Unless otherwise agreed in writing, invoices are payable per the terms stated on the invoice, and fees are exclusive of any applicable taxes, which are the client's responsibility where required by law.

5. Intellectual Property

The website, catalog, and all related content — including our name, logo, design, text, and the structure and compilation of our publisher database — are owned by Redhead or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. No other rights are granted. Content deliverables produced for clients are governed by the applicable Service Agreement.

6. Acceptable Use

You agree not to use the Services to violate any law, infringe third-party rights, transmit malware, attempt unauthorized access to our systems, or interfere with the operation of the Services.

7. No Guarantee of Results

Search engine rankings, organic traffic, and other SEO outcomes depend on factors outside anyone's control, including search engine algorithms and competitor activity. Except as expressly stated in a Service Agreement, we do not guarantee specific rankings, traffic levels, or business results, and nothing on this website constitutes such a guarantee.

8. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that catalog data will be complete or current at all times.

9. Limitation of Liability

To the fullest extent permitted by law, Redhead will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to your use of the Services. Our total aggregate liability arising out of these Terms will not exceed one hundred US dollars (USD 100). Liability under a Service Agreement is governed by that agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold Redhead harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.

11. Third-Party Services and Links

The Services may reference or link to third-party websites and services, including Google Sign-In and publisher websites. We do not control and are not responsible for third-party content, policies, or practices.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute arising out of these Terms or your use of the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless a Service Agreement between you and Redhead provides otherwise.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and Redhead regarding the Services.
